In a letter to Attorney General Eric H. Holder Jr., Judge Nicholas G. Garaufis of United States District Court in Brooklyn, wrote that the pending capital trial of the mobster, Vincent Basciano, on charges including murder had already cost the government more than $3 million in legal expenses, even though it will not begin until next year.
“The possibility of a death sentence ensures that these costs will grow substantially,” he wrote.
Judge Garaufis sentenced Mr. Basciano, a former acting boss of the Bonanno crime family who is known as “Vinny Gorgeous,” in 2008 to life in prison without the possibility of parole after his conviction on charges including attempted murder.“The remaining charges pending against Basciano are extremely serious, as are the crimes of which he has been convicted,” Judge Garaufis wrote. “But Basciano is already sentenced to life imprisonment. He is designated to serve his sentence under extremely restrictive conditions in one of the nation’s most secure penal institutions.”
The Justice Department did not respond to a request for comment.
Judge Garaufis’s name appeared on what prosecutors characterized as a hit list written by Mr. Basciano. Judge Garaufis declined to recuse himself from the case.
